Fitzpatrick Settles Lawsuit Brought Against Client IBM In The Eastern District Of Texas
The plaintiff Sky charged IBM with patent infringement, trade secret misappropriation, breach of contract, conversion and unjust enrichment. Shortly after suit was filed, Fitzpatrick filed a summary judgment motion on the conversion and unjust enrichment claims, causing the plaintiff to withdraw these claims. Then, following the Markman ruling, Fitzpatrick filed a motion for summary judgment of no patent infringement. Plaintiff thereafter settled the case, without any admission of liability or wrongdoing by IBM. Lead counsel for IBM were partners Donald J. Curry and Marc J. Pensabene.
